Partial commencement of Energy Transition Measures and Other Amendments Act 2024 from 1 July 2025 to facilitate shared access to critical energy infrastructure
29 July 2025
Pursuant to the Energy Transition Measures and Other Amendments Act 2024 (Commencement) (No. 2) Notification 2025 (“Commencement Notification No. 2”), further provisions of the Energy Transition Measures and Other Amendments Act 2024 (“Act”) came into force on 1 July 2025. These provisions relate to the following:
- Empowering the Energy Market Authority (“EMA”) to direct owners or occupiers of critical energy infrastructure to allow licensees access to their infrastructure;
- Requiring persons owning, managing, or controlling key electricity and gas assets to obtain approval from EMA before repurposing such infrastructure away from their original use;
- Allowing EMA to recover costs associated with energy security, market development and decarbonisation-related initiatives, which ensure the proper functioning of the energy system; and
- Empowering EMA to implement power rationing during emergencies.
By way of background, the Energy Transition Measures and Other Amendments Bill was introduced in Parliament on 6 August 2024 and was passed on
9 September 2024. The Act, which was gazetted on 25 October 2024, seeks to amend the Electricity Act 2001, the Gas Act 2001, and the Energy Market Authority of Singapore Act 2001 (“EMA Act”) to primarily:
- introduce guardrails for Singapore’s electricity market;
- strengthen EMA’s ability to regulate the power sector; and
- establish the Future Energy Fund (“Fund”).
On 8 November 2024, provisions in the Act relating to the establishment of the Fund under the EMA Act came into force. For more about the Fund, please read our article “Partial commencement of Energy Transition Measures and Other Amendments Act 2024 to establish Future Energy Fund”.
The other provisions in the Act relating to the setting up of a new regulatory regime for centralised gas procurement are not in force yet. For more about the Act, please read our article “Parliament passes Energy Transition Measures and Other Amendments Bill”.
